Fees
NICOLE NELSON shall receive a sales commission of twenty-five (25) percent of the final sale price of each item sold between $10 and $100, a sales commission of twenty (20) percent of the final sale price of each item sold between $100 and $500, a sales commission of fifteen (15) percent of the final sale price of each item sold between $500 and $999.99, a sales commission of ten (10) percent of the final sale price of each item sold between $1000.00 and $2999.99, a sales commission of seven (7) percent of the final sale price of each item sold between $3000.00 and $9999.99, and a sales commission of four (4) percent of the final sale price of each item sold over $10,000. If an item sells for less than $10, NICOLE NELSON shall be paid a one-time two dollar ($2) administrative fee per item listed. If any item does not sell, NICOLE NELSON will not receive a sales commission, but shall be paid a one-time two dollar ($2) administrative fee per item listed that does not sell. Consignor is to pay all eBay fees and payment services fees. These services include, but not limited to, reserve prices, a higher opening bid, gallery, featured item, bold, gift icon, relisting of the said item(s), automobiles, and real-estate. Nicole Nelson shall determine the duration of each auction. The duration of the auctions are either five (5), seven (7), or 10 (ten) days.
Terms of Service
3. Process
All aspects of the transaction will be conducted under the user ID missymoo777. This may include, taking possession of the item(s) for sale, quality inspection and cleaning / touch up of item(s) if necessary, photography / image hosting and description of item(s), correspondence with bidders, follow-up, and shipping.
4. Listing Prices
Missy Moo shall list the merchandise at the minimum retail price with any features or reserve price shown on the record of consignment
5. Sales Outside Auction Sites
If a higher price is offered via private offer or through a retail or direct purchaser BEFORE the item is listed on auction site, the owner of stated items will be contacted and notified to obtain an approval for sale or a decline of such offer.
6. Premature end of auction
Once item is listed, the auction will run the full course and must be sold to the highest bidder, regardless of price. If such an instance arises that the owner demands the item(s) to be pulled during an auction, the owner will pay a cancellation fee of $25.
7. Shipping
All shipping is to be handled by the trading assistant unless otherwise agreed upon. All buyers pay for shipping. However, shipping materials or specials such as ‘free shipping’ may also be taken out of the final price of the sale item(s). NICOLE NELSON agrees to show such fees to consignor in writing.
8. Payment(s)
Missy Moo shall pay the Consignor all proceeds due to the Consignor within (30) thirty days from end of the paid sale.
9. Accounting
Nicole Nelson shall furnish the Consignor with all accounting records pertaining to Consignors account at the Consignors request. Nicole Nelson shall maintain accurate books and documentation with respect to all transactions entered into on behalf of the Consignor.
10. Loss or Damage
Nicole Nelson shall make every effort to safeguard consigned item(s); however all risks of fire, theft, flood, accidental damage or breakage, any acts of nature resulting or any damage to the property delivered under this agreement shall be retained by the Consignor and the Consignor shall keep such property fully insured at the expense of the Consignor and for the benefit of and in the name of the Consignor.
11. Ownership
Consignor attests that they have legal title to and are in legal possession of all items and that which Nicole Nelson is to sell at auction.
